These Terms & Conditions apply to the use of FishZoon and associated FishZoon services.

By using FishZoon, creating an account or purchasing a subscription, the user agrees to these Terms.

1. FishZoon Service

FishZoon provides fishing-related technology, water analysis, location information, environmental information and other fishing tools. Features may be updated, improved or expanded as development continues.

2. Fishing Analysis & Recommendations

FishZoon provides fishing analysis and recommendations using available environmental data, location information, water conditions, scanner analysis and other relevant fishing information. Fishing and environmental conditions naturally change, and FishZoon’s analysis may change as new information becomes available.

3. Location Access

Certain FishZoon features require access to the user’s device location. Location is particularly important for location-based fishing information and the planned worldwide tide-data service. If the required location permission is disabled, those features may become unavailable or provide less relevant information.

4. User Responsibilities

Users are responsible for complying with applicable local laws, fishing regulations, licence requirements, permits, access restrictions and safety requirements.

5. Free Scans

New FishZoon users receive 7 free scans. After those scans have been used, continued access to subscription-only scanner functionality requires an active subscription.

6. Paid Subscriptions

FishZoon offers subscription periods of up to 12 months. The applicable subscription price, billing period and renewal information will be displayed before payment is confirmed. Where automatic renewal applies, the subscription will renew according to the selected plan unless cancelled before the next renewal date.

Subscriptions are paid for upfront for the full subscription period. Current prices are shown on the Subscription Fees page.

7. Cancellation

Users may cancel future subscription renewal. Cancellation normally prevents the next renewal payment while allowing access to continue until the end of the current paid subscription period.

8. Refunds

Paid subscriptions are generally non-refundable once the paid subscription period has started, except where a refund or cancellation right is required by applicable consumer law or the relevant app-store/payment provider rules. Nothing in these Terms removes legal consumer rights that cannot lawfully be excluded.

9. Service Availability

FishZoon may occasionally be unavailable because of maintenance, upgrades, internet connectivity, hosting services, mapping services, external data providers, tide services or other technical circumstances.

10. Intellectual Property

The FishZoon name, software, design, scanner technology, content and related materials are intended for use as part of the FishZoon service. Users may not reproduce, sell, distribute or commercially exploit FishZoon technology or content without permission, except where permitted by applicable law.

11. Changes to the Service and Terms

FishZoon may update its service and these Terms as development continues. Material changes may be published through FishZoon or FishZoon.com.

12. Accounts

Some FishZoon features require an account. Users are responsible for providing accurate information, keeping their login details secure and for activity that takes place under their account. Users should contact FishZoon promptly if they believe their account has been used without permission.

Users who are under the age of legal majority where they live need the permission of a parent or guardian to create an account or purchase a subscription.

13. Acceptable Use

Users must not:

• use FishZoon for any unlawful purpose or in breach of these Terms;
• attempt to gain unauthorised access to FishZoon, its systems or other users’ accounts;
• copy, modify, reverse engineer or interfere with FishZoon software or technology, except where the law allows it;
• use automated means to access or extract data from FishZoon without permission;
• resell or sublicense access to FishZoon.

14. App Stores and Third-Party Services

Where FishZoon is downloaded or paid for through an app store, the app store’s own terms and payment rules also apply. FishZoon relies on third-party services such as mapping, weather, tide and payment providers, and those services may be subject to their own terms. FishZoon is not responsible for third-party services it does not control.

15. Information Only

FishZoon provides information and analysis to help anglers make their own decisions. FishZoon does not guarantee that fish will be caught, or that scanner results, tide, weather, location or other environmental information will always be accurate, complete or up to date. FishZoon must not be relied on for navigation or as a substitute for official weather, tide, water and safety information.

16. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

Subject to that, FishZoon is not liable for loss or damage that was not reasonably foreseeable, that was not caused by FishZoon’s breach of these Terms, or that results from a user’s failure to follow these Terms, applicable laws or appropriate safety precautions. FishZoon is not liable for business losses, such as loss of profit, revenue or business opportunity.

17. Suspension and Termination

Users can stop using FishZoon at any time and can cancel subscription renewal as described in these Terms. FishZoon may suspend or end access to the service where a user seriously or repeatedly breaches these Terms, where required by law, or where necessary to protect FishZoon, its users or the service. Where appropriate, FishZoon will give notice before doing so.

18. General

If any part of these Terms is found to be unenforceable, the remaining parts continue to apply. If FishZoon does not enforce a part of these Terms straight away, it can still do so later. These Terms do not affect legal rights that users have as consumers under the law of the country where they live.

19. Governing Law

These Terms are governed by the laws of England and Wales, and disputes can be brought in the courts of England and Wales. Users who live in Scotland or Northern Ireland can also bring proceedings in their local courts. Users who live outside the United Kingdom keep the protection of any mandatory consumer laws of the country where they live.
